CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: September 8, 2008
Present: Richard Andrus, Timothy Lovett, Christopher Blair and David Dempsey
The meeting convened at 6:15p.m.

Levkoff, 26 Eaton Rd – NOI #230-0246, SMA RDA08-02 – improve existing walkpath, construct new walkpath and beach area and install a dock with a boardwalk on Lake Garfield. Continued from July meeting (D. Dempsey is the project manager).  Levkoff, 26 Eaton Rd – SMANOI 08-03 – to further develop the site while maintaining the existing single family residential use of the site. (D. Dempsey is the project manager) continued from the August meeting.
Tim Lovett recused himself from the table as a Conservation Commission member due to a conflict of interest.
The representative for the Levkoffs discussed the wetlands issues first and their plans.  The Board discussed that if there were going to be a sand beach this particular property the applicant would have to file each time they wanted to add more sand.  The Board agreed that this presentation looked a lot less intrusive than the previous one.  Fencing and property boundary options were discussed.  The Board requested a rough number of the sand to be hauled in.
The Board then discussed with the Levkoff’s representative the cutting plans under the Scenic Mountains Act and the Board has determined that the trees to be cut in areas 1 & 3 will need to be marked.  Questions were raised about the area surrounding the shed and the shed itself.  It was determined that the applicant is under the threshold of “disturbance of bank”.  A new proposal broken out with narratives for the WPA and SMA with numbers requested from the Board and how the materials will be transported will be submitted at the next meeting.  A final landscaping plan will also be submitted.  Once the trees have been marked a site visit will be scheduled.

For Discussion:
1.      Mail was reviewed.
2.      Minutes from 7/14 & 8/11/08 were approved as written.
3.      The Board reviewed the ZBA special permit application for the Moore’s at 12 New Marlboro Rd and responded to the ZBA the the project as proposed does not fall under their jurisdiction.
4.      The Board reviewed the letter from Meredith Oislander requesting permission to repair her dock and responded to Ms. Oislander that the Board will need a sketch (8 ½ x 11 sheet, hand drawn) of the current dock with dimensions to be submitted
5.      The Board briefly discussed the 2 Enforcement Orders that were issued; both parties will be at the October meeting.  The Erlich’s Attorney will be filing the necessary documents prior to the September 29th deadline and the Blair’s representative couldn’t make tonight’s meeting but will bring all the documents and plans to the October meeting.
6.      The Board reviewed the Catino file.  The contractor for the Catino’s, Joe Wilkinson was supposed to attend the meeting to discuss a less invasive and disruptive method of rip rap that he wanted to use.
7.      The Board discussed the fact that the mesh was put back on the split rail fence at the Jaffe residence which the Commission had asked to be removed and was at a site visit made last month.
